These Terms of Service (“Terms”) govern your use of www.a-starproperties.com and any related pages, property-search tools, accounts, forms, or online services that link to these Terms (collectively, the “Services”).
The Services are operated by A-Star Properties LLC (“A-Star Properties,” “we,” “us,” or “our”), an Idaho-licensed real estate brokerage. Shaun Howell serves as the broker of A-Star Properties LLC.
By accessing or using the Services, you agree to these Terms and our Privacy Policy. If you do not agree, do not use the Services.
We may update these Terms from time to time to reflect changes in the Services, technology, business practices, or legal requirements. The “Last Updated” date identifies the most recent revision.
Your continued use of the Services after revised Terms are posted constitutes acceptance of the revised Terms to the extent permitted by law.
You must be at least 18 years old and legally capable of entering into a binding agreement to create an account or use features that require contractual consent.
You are responsible for using the Services in compliance with applicable law.
The Services may provide real estate information, property-search tools, saved searches, market information, contact forms, account features, and ways to communicate with real estate professionals.
Use of the Website alone does not create a brokerage relationship, agency relationship, fiduciary relationship, attorney-client relationship, lending relationship, or other professional relationship.
A-Star Properties LLC provides real estate brokerage services through its broker and other properly licensed real estate professionals affiliated or associated with the brokerage. Shaun Howell serves as the broker of A-Star Properties LLC.
A brokerage relationship, agency relationship, or other representation relationship is created only as provided by applicable law and any required written brokerage or representation agreement. Merely visiting the Website, viewing listings, creating an account, or submitting a general inquiry does not by itself create such a relationship.
Real estate listings, property descriptions, prices, availability, measurements, school information, maps, photographs, market data, and other real estate information may come from third parties, public sources, listing brokers, multiple listing services, IDX providers, or other data providers.
We do not guarantee that listing or property information is complete, current, error-free, or independently verified. Property status, price, availability, features, and other facts may change without notice.
Before making a real estate decision, you should verify material facts with the appropriate licensed real estate professional and, where appropriate, qualified inspectors, attorneys, lenders, title professionals, surveyors, tax professionals, or other specialists.
Where the Services display MLS or IDX information, that information may be subject to rules, licenses, restrictions, and attribution requirements imposed by the applicable multiple listing service, listing broker, data provider, or IDX provider.
You may use listing information made available through the Services only for legitimate personal real estate purposes unless a separate written agreement permits another use.
You may not scrape, harvest, systematically download, republish, resell, redistribute, create a competing database from, or commercially exploit MLS or IDX content except as expressly permitted by law and the applicable data license.

We may suspend or terminate an account that is used in violation of these Terms or applicable law.
If you provide your contact information, we may communicate with you about your inquiry, requested services, saved searches, property activity, appointments, or an existing real estate relationship.
If you separately opt in to marketing emails, calls, or text messages, we may send marketing communications consistent with your consent and applicable law.
Consent to receive marketing communications is not a condition of purchasing real estate services.
A-Star Properties LLC, an Idaho-licensed real estate brokerage, sends text messages only to people who have opted in through our website forms or booking pages. Depending on the consent you give, these messages may include appointment confirmations and reminders, home valuation results, replies to your inquiry, and updates about a property or transaction. If you separately opt in to marketing text messages, they may include new listings, market updates, and home-selling tips.
You can cancel the SMS service at any time. Just reply STOP to any text message from A-Star Properties LLC. After you send the SMS message STOP to us, we will send you an SMS message to confirm that you have been unsubscribed. After this, you will no longer receive SMS messages from us. If you want to join again, just sign up as you did the first time and we will start sending SMS messages to you again.

Carriers are not liable for delayed or undelivered messages.
As always, message and data rates may apply for any messages sent to you from us and to us from you. You will receive messages only as needed for the services or updates you opted in to, typically a few messages per month, with more around a scheduled appointment or an active transaction. If you have any questions about your text plan or data plan, it is best to contact your wireless provider.

You may unsubscribe from marketing emails using the unsubscribe link in the message.
Our Privacy Policy explains how we collect, use, and disclose information and is incorporated into these Terms by reference.
You agree not to use the Services to:
If the Services allow you to submit comments, reviews, photographs, messages, property information, or other content (“User Content”), you remain responsible for the User Content you submit.
You represent that you have the right to submit the User Content and that it does not violate law or another person’s rights.
You grant A-Star Properties a non-exclusive, worldwide, royalty-free license to host, store, reproduce, display, and use your User Content as reasonably necessary to operate, provide, improve, or promote the Services. This license does not transfer ownership of your User Content to us.
We may remove or restrict User Content that violates these Terms, applicable law, or third-party rights.
The Services and their original content, design, branding, text, graphics, software, and other materials are owned by or licensed to A-Star Properties and are protected by applicable intellectual property laws.
Property listing data, photographs, brokerage marks, MLS marks, third-party logos, and other third-party materials remain the property of their respective owners or licensors.
Except as expressly permitted, you may not reproduce, modify, distribute, sell, license, publish, or commercially exploit protected content from the Services without authorization.
A-Star Properties supports the principles of the federal Fair Housing Act and applicable state and local fair housing laws.
We do not intend to discriminate in housing-related services based on race, color, religion, sex, disability, familial status, national origin, or any other characteristic protected by applicable law.
The Services may contain links to, data from, or integrations with third parties, including MLS or IDX providers, mapping services, lenders, title companies, inspectors, social platforms, and other real estate or technology providers.
Third-party services are governed by their own terms and privacy policies. We do not control and are not responsible for third-party websites, services, content, availability, security, or practices.
A link or integration does not by itself constitute an endorsement.
We do not guarantee that the Services or any feature, listing, account function, or content will always be available.
We may modify, suspend, restrict, or discontinue all or part of the Services at any time, subject to applicable law and any separate written agreement.
TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, THE SERVICES ARE PROVIDED “AS IS” AND “AS AVAILABLE.”
A-STAR PROPERTIES AND ITS SERVICE PROVIDERS DISCLAIM WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, TITLE, NON-INFRINGEMENT, ACCURACY, AVAILABILITY, AND UNINTERRUPTED OR ERROR-FREE OPERATION TO THE EXTENT SUCH WARRANTIES MAY LAWFULLY BE DISCLAIMED.
WE DO NOT WARRANT THAT PROPERTY INFORMATION, LISTING DATA, MARKET INFORMATION, THIRD-PARTY CONTENT, OR OTHER CONTENT AVAILABLE THROUGH THE SERVICES IS COMPLETE, CURRENT, OR ERROR-FREE.
Nothing in these Terms excludes warranties or rights that cannot lawfully be excluded.
TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, A-STAR PROPERTIES AND ITS OWNERS, OFFICERS, EMPLOYEES, CONTRACTORS, AGENTS, AFFILIATES, LICENSORS, AND SERVICE PROVIDERS WILL NOT BE LIABLE FOR INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, EXEMPLARY, OR PUNITIVE DAMAGES ARISING FROM OR RELATED TO THE SERVICES.
TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, OUR AGGREGATE LIABILITY FOR DIRECT DAMAGES ARISING FROM OR RELATED TO THE SERVICES WILL NOT EXCEED THE GREATER OF THE AMOUNT YOU PAID DIRECTLY TO A-STAR PROPERTIES FOR THE SPECIFIC ONLINE SERVICE GIVING RISE TO THE CLAIM DURING THE THREE MONTHS BEFORE THE CLAIM AROSE OR $100.
These limitations do not apply where prohibited by law.
To the extent permitted by law, you agree to indemnify and hold harmless A-Star Properties and its owners, officers, employees, contractors, agents, and affiliates from third-party claims arising from your unlawful use of the Services, your material violation of these Terms, or User Content you submit in violation of another person’s rights.
We reserve the right to control the defense of a matter subject to indemnification, and you agree to reasonably cooperate in that defense.
We may restrict, suspend, or terminate access to the Services if you violate these Terms, misuse the Services, create security or legal risk, or where termination is otherwise permitted by law.
Provisions that by their nature should survive termination will remain in effect, including provisions concerning intellectual property, disclaimers, limitations of liability, indemnification, and governing law.
These Terms are governed by the laws of the State of Idaho, without regard to conflict-of-law principles, except where another law must apply.
Unless applicable law requires otherwise, disputes arising from these Terms or the Services will be subject to the jurisdiction of the state or federal courts located in Ada County, Idaho.
If any provision of these Terms is held invalid or unenforceable, the remaining provisions will remain in effect to the fullest extent permitted by law.
Failure to enforce a provision of these Terms does not waive the right to enforce it later.
These Terms, together with the Privacy Policy and any additional terms or written agreements applicable to a specific service or real estate relationship, constitute the agreement governing your use of the Services.
Specific brokerage, agency, listing, buyer representation, transaction, MLS, or other real estate agreements will control to the extent they conflict with these Website Terms regarding the subject matter of those agreements.
